Course description:

In this course we will discuss approaches taken in different jurisdictions towards key problems of civil litigation. In particular, we will look at the following topics:

  • Court organisation
  • Costs and funding of civil litigation
  • Amicable settlement within and outside ordinary proceedings
  • Jurisdiction
  • Collective redress
  • Relationship between the judge and the parties
  • Evidence
  • Appeals
  • Arbitration and the courts

As this is a workshop-style course, attendance in class and participation in the discussions is obligatory and will count towards your grade. In addition, students are expected to give a presentation on one of the topics of the course. Furthermore, there will be an oral exam.
